Third Suspect In Brisenia Flores Murder to Be Tried

The last of the three defendants charged in the murder of nine-year-old Brisenia Flores  is scheduled to go to trial on June 1st. But the defendant’s lawyers have filed motions that could affect where the trial takes place. According to a report in the Arizona Daily Star the defense lawyers,

Steve West and Jack Lansdale have filed a motion to move the trial out of Pima County, arguing the media attention the case has received has destroyed any hope of finding a fair and impartial jury.

The defendant, Albert Gaxiola, is said to have taken part in the raid on the home of Raul Junior Flores that resulted in the shooting death of Flores and his daughter Brisenia. The other two people tried in this case, Shauna Ford and  Jason Bush are on death row awaiting their execution.

Also, Gaxiola’s attorneys claim and will file a motion alleging that

Gaxiola wasn’t read his Miranda rights until 13 pages into his interrogation and it’s not clear from listening to the conversation whether he ever said he understood his rights or that he wanted to waive them and answer their questions.

There is no word so far as to how the judge may rule on the motions.
